Terms of Service

1. Acceptance of Terms

By accessing or using the CarFriend platform (carfriend.in and associated subdomains), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, you must discontinue use immediately.

2. Definitions

• Platform means the CarFriend website, mobile interface, and associated services.
• Seller means any individual or entity listing a vehicle for sale.
• Dealer / Buyer means any registered and KYC-verified party bidding on vehicles.
• Auction means a time-bound live bidding event conducted on the Platform.
• Inspection Report means the certified 200-point evaluation document generated by a CarFriend inspector.

3. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts under Indian law to use this Platform. By using the Platform you represent and warrant that you meet these requirements.

4. User Accounts & KYC

All users must complete KYC verification before transacting. You are responsible for maintaining the confidentiality of your credentials. CarFriend reserves the right to suspend or terminate accounts that provide false KYC information or engage in fraudulent activity.

5. Vehicle Listings & Inspections

All vehicles listed on the Platform must pass a CarFriend certified inspection before going live. The Inspection Report is the authoritative record of the vehicle's condition at the time of inspection. Sellers warrant that they are the legal owners of the vehicle or have authority to sell it.

6. Auction Rules

Auctions are governed by the Auction Rules policy. All bids are binding commitments. The highest bid at auction close constitutes a binding agreement to purchase at that price, subject to final payment and transfer formalities.

7. Fees & Payments

CarFriend charges a platform fee on successful transactions. Fee schedules are disclosed prior to listing. Payment terms and timelines are as specified in the Seller Agreement. All fees are exclusive of applicable taxes.

8. Prohibited Conduct

• Bid manipulation, shill bidding, or collusion with other parties
• Listing stolen, encumbered, or legally disputed vehicles
• Providing false information in KYC or vehicle documentation
• Interfering with the Platform's technical operation
• Circumventing the Platform to transact directly after introduction through CarFriend

9. Limitation of Liability

CarFriend acts as a marketplace intermediary. While we conduct comprehensive inspections, we are not liable for undisclosed defects that could not be identified during a standard inspection. Our total liability in any dispute shall not exceed the platform fee paid for the relevant transaction.

10. Intellectual Property

All content on the Platform, including inspection reports, vehicle grades, logos, and software, is the intellectual property of CarFriend Technologies. Unauthorised reproduction, scraping, or redistribution is prohibited.

11. Governing Law & Disputes

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in Gujarat, India. We encourage good-faith resolution — please refer to our Grievance Redressal Policy first.

12. Amendments

CarFriend reserves the right to amend these Terms at any time. Continued use of the Platform after changes are published constitutes acceptance of the revised Terms.
